All KIDZ BOOK CLUB DVDs are sold subject to this DVD End User License Agreement. KIDZ BOOK CLUB DVDs are copyrighted material under Australian law. All rights are reserved.
The 2009 Introductory Season of the KIDZ BOOK CLUB comprises six DVDs. Each DVD has been produced as a Guide to Reading for non-commercial educational use. No authorisation is given to any party to alter, edit, copy, duplicate, distribute, exchange, rent out, charge to view, hire, supply or sell duplicate copies of KIDZ BOOK CLUB DVDs. To do so would be an infringement of copyright. Legal action may be taken if copyright law and / or the DVD End User License Agreement is breached.
WHO IS A DVD END USER ?
When a KIDZ BOOK CLUB DVD is purchased by, or for, a Primary School, then that Primary School is the DVD End User. For the purpose of the DVD End User License Agreement the Primary School is defined as "an organisation or entity that exists and operates at a set location in a single suburb." If a parent school or parish has two separate Primary Schools, at different locations (irrespective of whether or not they share a name) then there would be two separate DVD End Users. Hence there would be a need to purchase two copies of the same DVD if both Primary Schools wished to utilise the same Episode.
If five separate libraries were housed under the auspice of a Shire or Council (or linked to a main Shire or Council Library) but each of the five libraries existed and operated at a set location in a single suburb, then each of the five would be viewed as a separate entity or organisation for the purposes of the DVD End User License Agreement. Accordingly the main Shire or Council Library would need to purchase five copies of the DVD, plus one for itself, if it wished to house the same Episode in each of the six set locations.
The organisation or entity that qualifies as the DVD End User can play, exhibit and show their Episode as many times, to as many people, as deemed appropriate within the boundaries of its own infrastructure at its set location. It can be played, exhibited and shown via whatever medium the DVD End User deems appropriate within the boundaries of its own infrastructure at its set location.
